I just found out that the house across the street from ours is vacant. I live in a great location with most of the neighborhood to be senior citizens. The owner passed away about a month ago, and had no heirs.  I thought someone was there, because there is a car there just to ward off intruders. I am not sure who get this house? Extended family members pop in every once in a while, and I've been told there highly motivated to sell the house quickly, even though there in probate trying to figure out the shares?!   Whoever the court decides, I want to see what can be done to wholesale it

Question is: If the party is in probate, and working things out, can there be a deal where I put the house under contract now and sell the contract to another investor? Or do I have to wait a year or so?

You can always make an offer to the executor of the estate if you can determine who that is.  Probate could take anywhere from six months to two years.

Doubtful a contract assignment is feasible if the property is still tied up in probate.  Motivated heirs will likely accept a discounted offer if they can get a quick sale as soon as the property clears probate.
