 ORLANDO, FL – It was quite an honor to be asked by the folks at Rich Dad to speak on the subject of Short Sales and Foreclosures at their Annual Forum a few weeks ago. It was four days of 12 hours a day intense real estate investing education. I feel like I met and spoke with just about everyone of the more than 1000 people in attendance in that 96 hour period. What I learned from interviewing all of these different types of investors was quite interesting and I wanted to pass it along to you. (Plus, in case you are wondering about my experiences with hanging out with Robert Kiyosaki himself, I’ll touch on that as well.) So onto what I discovered that I think you will find quite intriguing.

Commercial real estate investors reveal a sense of hopefulness and improved sentiment with regard to the industry as the U.S. economy shows some encouraging signs of improvement, according to the first quarter 2010 findings of PricewaterhouseCoopers’ Korpacz Real Estate Investor Survey(TM), released March 16, 2010. The report notes that investors find it easier to envision a commercial real estate market recovery today than at any point during the past 24 months. At the same time, however, investors acknowledge that challenges and concerns still exist.

Early on in the recession, I believed it was just my imagination. But later I saw the effects of a recession I thought was make-believe. I saw massive job losses and too many foreclosures to think of. But the one thing that has continued to pay me are my apartments. The cash flow may not be as high as it was in prior years, but it’s still there. And believe it or not, so far in 2010, the cash flow has increased slightly. And that’s due to the fact that I’m running a lot more efficiently and cost consciously. I have turned my staff and myself into lean n’ mean apartment investing machines. So far, and God willing, our apartment investing has been recession-proof. Amazing, huh?

Overview…
This investment opportunity comes in two forms, either Tax Lien Certificates or Tax Deeds. The certificates serve as privately held notes secured by a common tax lien on real property. The virtues of this kind of investment are that they provide good security along with competitive rates of return. Of the 50 U.S. states, 32 utilize tax lien certificates at this time. The remaining states sell tax deeds on the property itself. The following explains how these differ.

The tax foreclosure process…
The local government uses this tax lien as leverage to ensure payment of the taxes. The law mandates a time period within which this must happen, before the property may be confiscated and sold. Proceeds of the sale pay the outstanding taxes. This parallels a typical mortgage foreclosure. After a mandated time period, the creditor may foreclose, which involves liquidating the asset through a sale or auction. The proceeds of the auction pay overdue debts plus the costs and expenses associated with the foreclosure action.
